Abstract

The present article deals with the debate on the possibilities of establishing a new pattern for the construction of the regime of participative democracy in the contemporary society. The thesis is that the democracy will be lived in its fullness, in an utopic, but pragmatic truth, only when the validity of ambivalent theories and perspectives on the development of the Law phenomenon are scientifically recognized and validated.
